LACLIMA, the first network of Latin American jurists with a focus on the development and dissemination of the Law applied to climate change, have published an important policy paper on the topic
Reflections about the legislative and regulatory framework of the policies that affect climate change in Brazil and proposals to improve this legal scenario and overcome the challenges of decarbonization in Brazil up to 2030 form part of the document “Proposals to overcome the legal challenges of decarbonization in Brazil up to 2030.” Prepared by LACLIMA, the first network of jurists in Latin America with a focus on the development and dissemination of legal knowledge applied to climate change, the policy paper also uses as a basis the recommendations highlighted in the publication “Climate and Development: visions for Brazil 2030.” The document is divided into four parts: (i) climate governance; (ii) financing and carbon pricing; (iii) environmental legislation, with a focus on waste management, agriculture and change of land use; and (iv) energy transition.
The document explains that is important to remember that the NDC (National Determined Contribution) presented by the countries “must be aligned with the objectives of article 2 of the Paris Agreement, namely: (1) the objective of holding the increase of the temperature of the Earth to 1.5 °C in relation to pre-industrial levels; (2) the objective of increasing the ability to adapt, fostering climate resilience and low carbon development; and (3) the objective of making financial flows consistent with a low carbon and climate-resilient development.” Read the paper in full!
